Terms and Conditions for StartWar

1. Acceptance of Terms

By downloading, installing, accessing, or using StartWar ("the App"), you ("User", "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, do not download, install, or use the App. These Terms constitute a legally binding agreement between you and the developer ("Developer", "we", "us").

2. Description of Service

StartWar is a turn-based geopolitical strategy game for entertainment purposes only. All nations, events, conflicts, diplomatic scenarios, and outcomes depicted in the App are entirely fictional and do not represent real-world political situations, endorsements, or predictions. The App is not affiliated with any government, military, or political organization.

3. AI-Generated Software Disclaimer

• The source code, game logic, server infrastructure, database schemas, user interface, and all technical components of this App were generated, in whole or in part, by artificial intelligence systems.
• The Developer does not warrant that AI-generated code is free from errors, bugs, security vulnerabilities, logical flaws, or unintended behaviors.
• You expressly assume all risk associated with using software that has been substantially generated by artificial intelligence.
• No AI provider, including but not limited to Anthropic (maker of Claude), OpenAI, Google, or any other AI service provider, bears any responsibility, liability, or obligation whatsoever in connection with this App, its functionality, its failures, or any damages arising from its use.
• The AI-generated nature of this software may result in unpredictable behavior, data handling issues, or security considerations that differ from traditionally developed software.

4. Limitation of Liability

The Developer shall not be liable for any:

• Indirect, incidental, special, consequential, punitive, or exemplary damages
• Loss of profits, revenue, data, goodwill, or business opportunities
• Damages arising from errors in AI-generated code or logic
• Loss of game progress, campaign data, or account information
• Service interruptions, downtime, or server unavailability
• Data breaches, unauthorized access, or security incidents
• Actions, omissions, or failures of third-party services (Firebase, Railway, Google Play, Expo)
• Device incompatibility, performance issues, or battery consumption
• Inaccurate game mechanics, calculations, or outcomes

MAXIMUM LIABILITY: In no event shall the Developer's total aggregate liability exceed the greater of Ten US Dollars ($10.00 USD) or the total amount you have paid to the Developer for in-app purchases in the twelve (12) months preceding the claim.

5. Waiver of Claims and No-Sue Covenant

• Waive any and all claims, demands, causes of action, and rights to sue the Developer, its affiliates, contractors, AI tool providers, hosting providers, and any related parties.
• Agree not to initiate, join, participate in, or benefit from any individual lawsuit, class action, collective action, or arbitration proceeding against the Developer related to the App.
• Release the Developer from all liability arising from the use, inability to use, or consequences of using the App, including but not limited to data loss, financial loss, emotional distress, or any other damages.
• Acknowledge that you have no expectation of compensation, remedy, or restitution from the Developer for any issue arising from App usage.

6. Indemnification

You agree to indemnify, defend, and hold harmless the Developer, its affiliates, officers, agents, and any AI service providers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content or data you submit through the App.

7. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate information when creating an account.
• You may not create accounts for the purpose of abusing the App, exploiting game mechanics, or disrupting other users.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• You must be at least 13 years old (or 16 in the EEA) to create an account.

8. In-App Purchases

• StartWar may offer optional in-app purchases to unlock additional nation tiers and game content.
• All purchases are processed through the Google Play Store and are subject to Google's terms of service.
• Purchases are non-refundable except as required by applicable law or Google Play's refund policy.
• We do not store your payment information.
• Game content and features may change at any time; purchased content is not guaranteed to remain unchanged.

9. Intellectual Property

All content in the App, including but not limited to graphics, text, game mechanics, user interface designs, and audio (whether human-created or AI-generated), is the property of the Developer or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on the App without prior written consent.

10. Use of Data

By using the App, you consent to the collection and use of your data as described in our Privacy Policy. You acknowledge that:

• Your gameplay data may be used for analytics and game improvement purposes.
• Leaderboard data (display name and scores) is visible to other players.
• Data may be stored on servers in various jurisdictions.
• We are not liable for any consequences arising from the processing, storage, loss, or breach of your data.

11. Service Availability

We do not guarantee uninterrupted, timely, or error-free service. We may modify, suspend, or discontinue the App (or any part of it) at any time without prior notice and without liability. Server maintenance, updates, and unforeseen issues may cause temporary or permanent service disruptions.

12. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use cheats, exploits, automation software, or hacks
• Interfere with or disrupt the App's servers or networks
• Impersonate another person or entity
• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to other users' accounts or data

13. Dispute Resolution

Any disputes arising from these Terms or the App shall be resolved through binding individual arbitration, not in court. You waive any right to participate in a class action lawsuit or class-wide arbitration. Arbitration shall be conducted under the rules of the jurisdiction where the Developer is located.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the Developer's country of residence, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the App after changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer regarding the App and supersede all prior agreements, understandings, and communications.
